RIGHT TO INFORMATION (RTI)

THE PREVENTION OF CRUELTY TO ANIMALS ACT, 1960
(59 of 1960)

As amended by Central Act 26 of 1982. 

 
An act to prevent the infliction of unnecessary pain or suffering on animals and for that purpose to amend the law relating to the prevention of cruelty to animals. 
 
Duties of persons having charge of animals   It shall be the duty of every person having the care or charge of any animal to take all reasonable measures to ensure the well being of such animal and to prevent the infliction upon such animal of unnecessary pain or suffering.
 
PERFORMING ANIMALS RULES   (I) 1973 
 
Performing animals means any animal which is used at, or for the purpose of any entertainment to which the public are admitted through sale, of tickets.
  • Every application by a person desirous of exhibiting or training any performing animal for registration under the Act shall be in the form and shall contain the particulars set out in the first Schedule.
  • Every such application shall be made to the prescribed authority within whose jurisdiction the applicant ordinarily resides and, if he has no fixed place of  residence, the application shall be made to such authority as the Central Government may by order specify in this behalf.

PREVENTION OF CRUELTY TO ANIMALS TRANSPORT OF ANIMALS) RULES 1973  (II)

 

The rules shall apply to the transport by rail or road other of cows, bulls, bullocks, buffaloes, yaks and calves. (herein referred to as cattle).

A valid certificate by a qualified Veterinary surgeon to the effect that the cattle are in a fit condition to travel by rail or road and are not suffering from any infectious or contagious or parasitic diseases and that they have been vaccinated against rinderpest and any other infectious or contagious or parasitic diseases shall accompany each consignment.

In the absence of such a certificate, the carrier shall refuse to accept the consignment for transport.

 
PREVENTION OF CRUELTY TO ANIMAL (SLAUGHTER HOUSE) RULES, 2000 III) 
 

Animals not to be slaughtered except in recognized or licensed houses-

(i) No person shall slaughter any animal within a municipal area except in a slaughter house recognized or licensed by the concerned authority empowered under the law for the time being in force to do so.`

(ii) No animal which is pregnant or has an offspring less than 3 months or has not been certified by a Veterinary Doctor that it is in a fit condition to be slaughter, shall not be slaughter.

Maximum load for draught animals (1) No person shall cause any animal specified in column 1 of the table below to draw a vehicle of the kind described in the corresponding entry in column 2 thereof if it carries a load in excess of the weight specified in the corresponding entry in col. 3 thereof.

PREVENTION OF CRUELTY TO ANIMALS (REGN. OF CATTLE PREMISESRULES, 1978  (V)
 

Registration of premises: Every person owning or in charge of premises in which not less than five heads of cattle are kept for the purpose of profit shall, in any case, where the premises are already in existence, within three months from the commencement of these rules and, in any case where, after the commencement of these rules any such premises, apply to the registering authority for the registration of such premises. 

Every application for registration shall contain full information regarding the number and all types of animals kept or to be kept, the purpose for which they are being kept or are to be kept, the provision made or to be made as respects floor space, flooring ventilation, supply of food and water, disinfection, drainage, disposal of dung or unwanted matter, boundary walls and shall also contain such other information relevant to the matter as may be specifically called for by the registering authority. 

Every certificate shall be valid for a period of three years from the date of issue thereof, but it may be renewed form time to time on application made by the person owning/in charge of the premises, within three months from the date of expiry of the existing certificate.
